This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from https://sundryclothing.com/ (the “Site”).

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. - We improve our products and advertising by using Microsoft Clarity to see how you use our website. By using our site, you agree that we and Microsoft can collect and use this data. 

Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information.” You may, however, browse our website anonymously. 

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

USE OF INFORMATION 

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use this Order Information to:

1) To communicate with you
The email address you provide for order processing will only be used to send you information and updates pertaining to your order. Unless you decide to opt-in to our promotional newsletter lists. 

2) To process transactions
Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested. 

3) To improve your experience

When in line with the preferences you have shared with us, we provide you with information or advertising relating to our products or services. This includes serving relevant ads across the web. We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

SECURITY 
Within our website exists a variety of security measures, to maintain the safety of your personal information when you place an order or enter your personal information. Credit cards are processed securely through authorize.net, a leading provider of payment gateway services online, or PayPal, a third party online processing service.  You will have the option to check out through either method. 

We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.

After a transaction, your private information (credit cards, social security numbers, financials, etc.) will not be stored on our servers. 

SHARING OF INFORMATION 
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

Sundry Clothing believes in protecting personal information, and understands that doing so is critical to help preserve the trust and confidence of our customers. CCPA and GDPR-compliant features are built into our platform, including features to enable us to offer our customers transparency into and control over their personal information. Please take confidence in knowing that our platform complies with privacy and data protection laws like the CCPA and GDPR.

CALIFORNIA PRIVACY RIGHTS 
Because we value your privacy we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We, therefore, will not distribute your personal information to outside parties without your consent.  

EUROPE RIGHTS

DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

MINORS

The Site is not intended for individuals under the age of 16, and we do not knowingly collect Personally Identifiable Information from children under 16 years of age. If you are under the age of 18, you must have your parent’s permission to access the Services. If you learn that your child has provided us with Personal Information without your consent, you may alert us at info@sundryusa.com. If we learn that we have collected any Personal Information from children under 16, we will promptly take steps to delete such information and terminate the child’s Account.

CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

MOBILE MESSGE SERVICE TERMS & CONDITIONS

The Sundry Clothing mobile message service (the "Service") is operated by Klaviyo (“Klaviyo”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

Text messages may be sent using an automatic telephone dialing system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchasing any goods or services. If you have opted in, the Service provides [If you send transactional messages: updates, alerts, and information (e.g., order updates, account alerts, etc.)][If you send promotional messages: promotions, specials, and other marketing offers (e.g., cart reminders)] from Sundry Clothing via text messages through your wireless provider to the mobile number you provided. Message frequency varies. Text the single keyword command STOP to 1 (833) 798-0619 to cancel at any time. You'll receive a one-time opt-out confirmation text message. If you have subscribed to other Klaviyo mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages. 

You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages or costs arising from your use of the Service or from you providing us with a phone number that is not your own.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
